Terms and Conditions

1.    Kids Coupons is Kids Coupons Pty Limited (a company registered with Australian Business Number 65 144 549 860) of Level 1, 42 Victoria Street, Grafton, New South Wales 2460, Australia (“Kids Coupons”).
2.    Kids Coupons periodically produces in printed form, and may also produce in electronic form, a book of Coupons by which Retailers offer discounted goods or services to Customers (the “Kids Coupons Book”).
3.    A Coupon is a voucher displayed in the Kids Coupons Book describing goods and/ or services and the discounts applicable to them if purchased by a Customer who at the same time provides the relevant Coupon to the Retailer.
4.    A Coupon may have an expiry date and may have other specific terms and conditions applying to its use.
5.    A Customer is any person who purchases the Kids Coupons Book and/or uses or attempts to use a Coupon from the Kids Coupons Book.
6.    A Retailer is any person who offers discounts or bonuses on goods or services to Customers by way of Coupons.
7.    Kids Coupons and Retailers are independent parties and are not partners, joint venturers or principal and agent.
8.    Kids Coupons acts solely in the capacity of introducer and is not responsible for and disclaims liability for all acts and/or omissions of Retailers and/or any defects in or damage, injury or loss caused by a Retailer’s goods or services.
9.    In no circumstances will Kids Coupons or its related bodies corporate or its directors or members of staff be liable to a Customer for any direct, indirect, incidental, special and/or consequential losses or damages or loss of profits of whatever nature howsoever arising from or relating to any material or information displayed in a Kids Coupons Book or from the conduct of any Retailer or distributor of the Kids Coupons Book.
10.    Customers are required to release Kids Coupons to the full extent allowed by law from any liability in respect of goods and/or services provided by Kids Coupons and/or Retailers and/or distributors of Kids Coupons Books.
11.    Kids Coupons’ liability to any Customer in any event is limited to the refund of the price paid for the Kids Coupons Book.
12.    Kids Coupons is not responsible for the content of any websites operated by third parties which may be referred to in the Kids Coupons Book or which may appear on a Kids Coupons website. Kids Coupons does not endorse any material appearing on such third party websites and following a link to such websites is done at the Customer’s own risk.
13.    Customers must refer any complaint or claim to the Directors of Kids Coupons who will endeavour to resolve the matter without delay and by mutual agreement before taking any further steps to pursue the complaint or claim.
14.    If a matter cannot be resolved by agreement, the dispute must be referred to mediation by a mediator agreed by the parties or, if no mediator can be agreed, then by a mediator appointed by the President of the NSW Law Society.
15.    Court proceedings may not be pursued by a Customer unless the dispute has first gone to mediation as above.
16.    Kids Coupons is committed to protecting the privacy of personal information collected from Customers and other persons as part of its normal business operations, activities and services and will at all times only use such information in accordance with NSW and Federal privacy legislation.
17.    The material in Kids Coupons Books and/or on any website operated by Kids Coupons is protected by copyright. This material may not be used (except for the intended purpose), copied, reproduced, published, stored in a retrieval system, altered or transmitted in any form or by any means in whole or part without the prior written approval of Kids Coupons and the Retailer, advertiser or other party that owns and has supplied the material to Kids Coupons.
18.    The Kids Coupons logo and the logos of Retailers and/or advertisers are registered trademarks of the relevant owners. Other trademarks may also be displayed by Kids Coupons from time to time and these may belong to third parties. Nothing published or otherwise displayed by Kids Coupons should be construed as granting any license or right of use of any logo or trademark without the express written permission of the relevant owner.
19.    These Terms & Conditions of Use and all other specific and additional terms which may be incorporated by reference thereto will be governed by and construed in accordance with the laws of the state of New South Wales, Australia.
20.    A Customer must only use or attempt to use a Coupon if he or she accepts these Terms & Conditions of Use and any use or attempted use of a Coupon will be deemed to be acceptance of these Terms & Conditions of Use.
21.    Kids Coupons reserves the right to amend these Terms & Conditions at any time by emailing Customers or posting changes online at www.kidscoupons.com.au.
